Employment Pass EP

 

For expatriates intending to take up employment within a Malaysian organization, an approved employment permit is required in the form of an Employment Pass (EP) by the Immigration Department of Malaysia.

In conjunction, for Malaysian organizations looking to hire expatriate employees, an approved Expatriate Employment Pass (EEP) is also required. This is due to the restrictions placed on the number of employable foreign workers within a Malaysian company.

Some key information pertaining to Employment Permits (EP) will be listed below.

Types of Employment Permits (EP)

Employment Pass (EP)

Employment Pass II (EPII)
Employment Pass III (EPIII)
– Fixed monthly income of minimum RM10,000.
– Fixed monthly income between RM5,000-RM9,999.
– Fixed monthly income between RM3,000-RM4,999.
– A valid employment contract of minimum 5 years.
– Valid employment contract of 2 years.
– Employment contract period not exceeding 1 year.

Qualified Working Roles

There are 6 categories in which the applicant will need to fulfill at least one to be eligible for this professional permit (PVP). These categories include:

● Expertise Transfer

E.g: Installation & Fixing of Machines and Equipment Expert; Technical Advisor

● Research

E.g: Researcher, Research Assistant

● Training

E.g: Professor; Lecturer; Speaker

● Volunteers

● Exhibitors under regulation of Malaysia Convention & Exhibition Bureau (MyCEB)

Important Information

● The PVP is valid for up to 12 months ONLY, it is non-renewable and a new application will need to be made.

● Applicants must be outside of Malaysia/in their country of origin when applying for a PVP.

● In the event of a change in employer while the professional visa is still valid, the PVP holder will need to cancel the current pass and serve a 3 month cooling period before reapplication.

● PVP holders are not entitled to apply for Dependent Passes for his/her family members.

▶ Supermarkets/mini markets (with less than 3000 sqft. sales floor)

▶ 24hr convenience stores

▶ News agents

▶ Miscellaneous goods stores

▶ Provision shops/general vendors

▶ Medical centres providing traditional/alternative medicines

▶ Convenience stores situated in petrol stations

▶ Permanent wet market stores

▶ Permanent pavement stores

▶ Shops providing textile/bistro/jewellery

▶ Non-exclusive restaurants

▶ National Strategic Interest

Application Timeline

 

After receiving the appropriate approval from all relevant parties, the candidate can begin the EP/EEP application process. This may take up to 2 weeks (14 days) to process. Do note that insufficient application documents may extend processing time up to 3 months.

The 5-step process includes:

1. Create account (online registration)

2. Submit online application

3. Application is processed by Department of Immigration

4. Status notification

5. Company activation

Additional Information

 

● EPIII holders (refer to Types of Employment Permits section) who have consecutively renewed their Malaysian permit up to 2-3 times are required to adhere to a cooling off period by leaving the country for 3 months.

● EPIII holders looking to change employers have to serve a mandatory 3 month cooling-period to reapply.
